Terms of Use (EULA)

1. Acceptance of Terms

By accessing or using the OtFit AI mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Description of Service

OtFit AI provides AI-powered virtual clothing try-on and styling recommendation services. The App allows you to:

• Upload and manage your wardrobe items
• Generate virtual try-on images using AI technology
• Receive AI-based styling recommendations
• Save generated looks privately in My Lookbook
• Explicitly publish a generated look when the limited Story pilot is available

3. Account Registration

To use certain features, you must create an account by providing a valid email address and creating a password, or signing in through Google or Apple. You are responsible for:

• Maintaining the security of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

You must be at least 18 years old to use the App. New and existing users must confirm age with a date of birth before accessing customer features. The date of birth is not stored; only the 18+ eligibility result, policy version, Firebase Auth account generation (account creation time), and confirmation time are recorded. Users under 18 may sign out or delete the account, but cannot use AI, wardrobe, history, Story, advertising, or purchase features. Parental or guardian consent does not create an exception. Providing a false date of birth or attempting to bypass this check may result in suspension or termination of access.

4. Plans, Passes & Billing

4.1 Wardrobe Completion Reward

Registration alone does not grant try-ons. After adding 2 accepted tops and 2 accepted bottoms, a user who explicitly claims the reward receives 3 free try-ons once per account, available for 30 days from the claim date. Signup benefits issued before this policy remain usable only until their original expiry and are not newly granted or extended.

Only one account on a device may receive this reward during the grant month and the following 11 calendar months. Switching or deleting accounts or reinstalling the App does not reset the device limit. Shared-device, second-hand-device, and customer-support reset exceptions are not provided. This promotional limit does not restrict sign-in, paid purchases, or benefits already owned.

4.2 Available Plans

• Free: After the wardrobe reward is used or expires, 2 base try-ons per personal 30 days, use at most 1 per KST week, no rollover
• Plus: 10 per month, roll over up to 10 unused included try-ons, hold up to 20
• Pro: 22 per month, roll over up to 22 unused included try-ons, hold up to 44, with no banner or forced ads

Subscriptions appear only when the corresponding Store products are active. The binding price is the localized price shown by the App Store or Google Play on the final purchase screen.

4.3 Optional Rewarded Ads

The production release temporarily disables advertising while safe account-switch lifecycle handling is completed. When the feature is available, Free, Plus, and Pro users may choose a rewarded ad only when the option is shown in the App. Each server-verified completion then grants 1 try-on, with at most 1 grant per KST week and 2 in any rolling 30 days. Each rewarded try-on expires after 7 days. Pro has no banner or forced ads.

4.4 One-Time Try-On Passes

One-, three-, and five-use passes appear only when the corresponding Store products are active. The binding price is the localized Store price shown at purchase. Passes do not auto-renew and do not expire before account deletion.

4.5 Billing

Subscriptions are billed monthly and will automatically renew unless canceled at least 24 hours before the end of the current billing period. You can manage or cancel your subscription through your App Store or Google Play Store account settings.

4.6 Refund Policy

All payments are processed through the App Store (iOS) or Google Play Store (Android). Refund requests must be made through the respective platform. We do not offer direct refunds for subscriptions or one-time passes.

5. User Responsibilities

You agree NOT to:

• Upload inappropriate, offensive, or illegal content
• Impersonate others or provide false information
• Attempt to reverse engineer or hack the App
• Use the App for commercial purposes without authorization
• Share content that violates others' intellectual property rights
• Upload sexually explicit, violent, or discriminatory images

6. Content Moderation & Ban Policy

6.1 Content Validation

All uploaded images are automatically screened by AI. Images that do not meet the submission requirements are rejected without being saved.

Ordinary non-clothing images; ordinary product or person photos of underwear, lingerie, swimwear, sleepwear, or pajamas; and text-only cards, captions, signs, or screenshots, even when they mention sexual terms, are invalid but non-punitive. They are rejected without being saved and do not add a violation strike.

6.2 User Reports

Users can report inappropriate content. If a story receives 5 or more reports, it will be automatically hidden and reviewed by our moderation team.

6.2.1 Private AI-Generated Result Reports

You can report a private AI-generated result in the App without sharing it publicly. A report records the account and account-generation identity, immutable result or reference identifier and digest, selected fixed reason, server timestamps, and moderation status. No image is re-uploaded and no free-form text is collected. The report, moderation queue, and request receipt remain private, are used only for safety and moderation, and are deleted through account deletion. A reported pending full-body model candidate's already-owned private image artifact may remain under a moderation hold until terminal review or account deletion. No duplicate image is uploaded to or stored in the report documents. Operator access is restricted, and mobile clients cannot read moderation queue state.

6.3 Account Suspension

An automated violation strike applies only when non-text visual content itself depicts explicit sexual activity or explicit nudity. Your account is automatically locked after 3 such violations; ordinary invalid uploads and text-only content do not count toward this automated 3-strike rule.

Repeated content violations may result in warning notices, temporary restrictions, account locks, or permanent bans depending on severity and abuse history.

We may use both app-level account locking and server-side enforcement tools to protect users and the service. Severe violations (illegal content, harassment, hate speech) may result in immediate permanent suspension without prior warning.

7. My Lookbook and Limited Story Pilot

7.1 Private Lookbook

Generated try-on results are private by default and may be saved to My Lookbook. Saving a result does not publish it to other users.

7.2 Public Story Pilot

Story is a limited, feature-gated pilot and may not be available to every user. When available, only an explicit public-share action publishes a generated look. A published Story is visible for 24 hours and is then automatically deleted. Anonymous posts still retain the publisher identity internally for safety and service operation. Likes, reports, automatic hiding after 5 reports, and content moderation apply.

8. Intellectual Property Rights

8.1 Your Content

You retain ownership of images you upload. By uploading content, you grant us a license to process, store, and display your content solely for providing the Service.

8.2 Generated Images

AI-generated virtual try-on images are created for your personal use. You may download and share these images, but commercial use without permission is prohibited.

8.3 Our Content

All intellectual property rights in the App (design, code, logos, trademarks) belong to OtFit AI and are protected by copyright and trademark laws.

9. Personal Photos and Private Full-Body Models

When the feature is available under your current plan or benefit, you may use a full-body photo for a fitting or create a private full-body model from a face photo and profile information:

• The selected photo and required fitting inputs are processed through the Google Gemini API, including the Nano Banana 2 image route
• For requests handled by the legacy face-personalization compatibility path, the face photo and Gemini-generated image may also be sent to Replicate for face-swap processing until that compatibility path is retired
• The original full-body or face photo is not saved to account storage or retained in OtFit's own systems after processing
• Replicate processing is governed by Replicate's current terms, privacy policy, and data-retention policy; OtFit does not guarantee a provider-side deletion interval
• An unconfirmed model candidate remains private for up to 24 hours, then is automatically deleted. However, an already-owned private image artifact for a reported unconfirmed candidate may remain under a moderation hold until terminal review or account deletion.
• A confirmed model remains private until it is replaced, deleted by you, or removed with account deletion
• Model generation may use gender, height, weight, body type, and age group; nationality is neither collected nor inferred

10. Third-Party Services

The App integrates with third-party services:

• Google (Firebase): Authentication, data storage, analytics
• Google Gemini API: Clothing analysis, virtual try-on, and private full-body model generation
• Replicate: Face-photo processing for requests handled by the legacy face-personalization compatibility path
• RevenueCat: Subscription and in-app purchase management
• Google AdMob: Free/Plus banner ads and optional rewarded ads when advertising is enabled and shown in the App

These services have their own Terms of Use and Privacy Policies. We are not responsible for third-party services.

11. Disclaimers & Limitations of Liability

11.1 Service Availability

The App is provided "as is" without warranties of any kind. We do not guarantee uninterrupted or error-free service.

11.2 AI Accuracy

Virtual try-on images are AI-generated approximations. Colors, fit, and appearance may differ from actual products. We do not guarantee accuracy of AI-generated images.

11.3 Limitation of Liability

To the maximum extent permitted by law, OtFit AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.

12. Account Termination

12.1 By You

You may delete your account at any time through App Settings > Account > Delete Account. Most app data is deleted immediately when the request is processed. A one-way hash of your email may be retained on a limited basis to prevent abusive re-registration.

12.2 By Us

We reserve the right to suspend or terminate accounts that violate these Terms or engage in prohibited activities.

13. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will notify you via email or in-app notification at least 30 days before the changes take effect. Continued use of the App after changes constitutes acceptance of the updated Terms.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Republic of Korea. Any disputes shall be resolved through arbitration in Seoul, South Korea, or through the courts of Seoul.
